The current general terms govern the relationship between DressYou Asset Ltd., on the one hand, as a supplier / seller and users using the e-shop based on a website at www.dressyou.net, on the other hand, regarding the offering, conclusion and execution of distance purchase contracts with the object - goods, clothing, shoes, bags, accessories, and household goods offered for sale by the supplier.

These terms and conditions are binding on all persons: guests - visitors to the website or users who have registered an account in the site.

When using the e-shop, the persons are obliged to comply with these General Terms and Conditions, as well as the applicable legislation of the Republic of Bulgaria and the European Union.

The persons using the e-shop declare with active action - by pressing the corresponding button their consent to these general terms and conditions. For the registered users, this consent is provided upon registration of the respective profile in the e-shop, and for the user - guests on the web site, upon execution of the respective order.

E-shopis a website /domain/ www.dressyou.net and its subdomains

User is an individual, using the e-shop.

Order is the consumer's order for certain Goods selected by him, with a certain price, with an obligation to pay the final price of the order and the chosen method of payment for the same, as well as the place of receipt of the Goods subject to the order.

Goods All goods - visualized and offered by the Supplier in the online store at www.dressyou.net.The Supplier offers for sale used second-hand goods that are not purchased directly from the manufacturer and do not assume any guarantee of their authenticity and quality.

Price of the Goods is the price for a piece specified in (country’s currency) , including value added tax.

Price of delivery are the costs of delivering the Goods to the consumer, including value added tax.

The final price of the Order means in total the Price of the Goods and the Price of the Delivery.

Profile is part of an online store that contains user information provided upon registration.

Personal data are personal data within the meaning of the General Data Protection Regulation (EU) 2016/679 in force since 25.05.2018 and the Personal Data Protection Act.

A virtual wallet a personal section in the e-shop related to the registered profile of the respective registered user, through which the seller, at the request of the user, returns to the latter the funds paid by him in case of cancellation of the sales contract concluded at a distance.

3. Subject of the distance contract for sale and purchase

3.1. The Supplier sells and delivers Goods at a distance to the User through the Online Store after an explicit statement - an order by the User, consisting of selecting the user of certain goods in a virtual "shopping cart", by pressing the "add" button and completing the the order by pressing the button "order with obligation to pay the final price".

3.2. The consumer pays the final price of the order according to the terms and conditions of these General Terms and Conditions.

3.3. The Supplier, after confirming the order placed, undertakes to deliver the goods to the consumer, in accordance with the terms of these General Terms and Conditions and at the place specified in the user's order.

4. Use of the e-shop by guest users or through a registered user profile

4.1.Purchase of goods offered by the supplier through the e-shop can be done by fully capable users - individuals guests on the website or such - who have registered an account in the latter.

4.2.When a customer - website guest purchases, the user adds the selected items to the "virtual shopping cart" by pressing the "add" button individually for each selected item, thereby storing / reserving the selected items in the shopping cart for the period of 30 minutes. In order to submit the order to the supplier, the consumer should electronically fill in certain information, including personal data, namely: first name and surname; valid email address; telephone; place of delivery, which may also be the delivery address specified by the user; method of payment; additional notes on the order.

4.3.In order to complete the order, the guest user must press the active button "order with payment at final price". By clicking on the button, the user agrees to pay the final price of the order and agrees to these general terms and conditions of the supplier

4.4.Shopping can also be done by a registered user by registering a user profile in the online store and accessing - entering an online store through the same account. In order to register and use the profile, the user must provide and complete electronically the following information containing personal data: first name and surname; valid email address; and by clicking on the active Registration button, the user registers his account and agrees to the provider's current terms and conditions. Registration can also be accelerated through third-party platforms, such as Facebook and Google+, for which the provider makes available active pushbuttons via the appropriate user-selected platform. In the latter case, "DressYou" Ltd. gains access to the personal data of the user required for the registration, collected by Facebook or Google respectively. After registering, the user has access to their account or shopping functionality in the online store, by entering to an email address and password, and pressing the active login button. The Provider also provides on its web site the ability to quickly access the relevant consumer profile and through third-party platforms, such as Facebook and Google+, and the user should click on the corresponding active "INPUT" button associated with the respective platform

4.5.When shopping through a registered user profile, the user can select and add items to the "virtual shopping cart" by pressing the active "add" button individually for each selected item, which enables him to keep / reserve the same items in the shopping cart for a period from 30 minutes. In order to complete the order, the registered user should fill in information regarding: choice of delivery address and payment method, and press the active button "order with payment at final price". By clicking the button, the user is obliged to pay the final price of the order

5. Prices and payment methods. Supplier Confirmation Order

5.1.In the online store www.dressyou.net, for each offered by the provider and the visualized product, a specific sale price of the product is indicated, as well as information on the main characteristics of the product aimed at assisting the relatively informed consumer in making his / her choice to buy the product from a distance or not to buy it. All prices of goods are binding on the supplier from the moment of their publication, the supplier reserves the right to change them unilaterally without notice. The supplier cannot change the price of the goods - the subject of the order made by the user or confirmed by the supplier

5.2.The final price of the Order can be paid in one of the following ways, according to the desire stated by the user when generating the order

  • By cash on delivery - payment is made at the moment of delivery of the Goods, when the courier visits the delivery address specified by the user and delivers the Goods to the consumer or to a person specified by the latter when generating the order. The final price of the order is passed to the courier.
  • Via the e-pay payment platform, via debit or credit card through a virtual POS terminal. Payment cards are: VISA, MasterCard, Maestro, issued by banks in countries other than the US, Canada, Trinidad and Tobago, Nigeria, Brazil, Mexico, Australia, Colombia, Kuwait, India, New Zealand , UAE.
  • Cash upon receipt of the goods ordered at the supplier's commercial premises at the address: 92, Hr.Botev Blvd., Plovdiv

5.3. The obligation to pay the Final Price for the order arises for the user from the moment of pressing the active button "order with the obligation to pay the final price"

5.4. The distance selling contract with the object - the goods ordered by the consumer binds the supplier from the moment the explicit confirmation of the order by the latter. To this end, the supplier sends an explicit e-mail to the consumer, stating that the order made by the consumer for the goods selected by the consumer for the corresponding final price has been accepted under the corresponding fulfillment number by the supplier

5.5. In order to avoid any disputes, the consumer accepts that the supplier will be bound by the orders made by the former only if the latter has confirmed these orders in accordance with Art 5.4

5.6. The Provider will consider as valid any order made by a user-guest on the website or by a registered user through a registered account in the online store at www.dressyou.net, as executed on behalf of and on the expense of the individual whose personal data is completed when generating and completing the order, respectively when registering the account, whether or not this order was made personally by the same person

6. Delivery

6.1. The goods are delivered to the place of delivery specified by the User, which may be: the commercial premises of the supplier in the city of Plovdiv, bul. ”Hr. Botev ”№92; address of Speedy courier's office on the territory of the Republic of Bulgaria or address of the recipient on the territory of the Republic of Bulgaria.

6.2. The goods are delivered against the signature of the consumer or the addressee designated by the first to receive the goods. When delivering the goods to an address outside Plovdiv, the same is done through a third party providing courier services. In case it is impossible to deliver the goods at the first visit to the address specified by the User and the person, it is not the fault of the Supplier and / or the courier (in case there is no one at the address, etc.), the supplier makes an effort to contact the user of the specified from the last phone or email within 2 / two / business days to specify a new time for delivery. In the event of failure to deliver and in the second attempt, it is not the fault of the Supplier and / or the courier and in the case of guilty behavior on the part of the consumer or the person indicated by the first person, his / her addressee, preventing the transmission / receipt of the goods / guilty act or inaction, preventing the delivery / receipt of the goods /, the Supplier shall be released from his obligation to deliver the goods actually ordered within the time limits specified in the following Art. 6.3.

6.3. Delivery times for the Goods are as follows:

  • For delivery to an address within the city of Plovdiv - 2 / two / working days, starting from confirmation of the order.
  • For delivery to other settlements - 2 / two / working days after order confirmation.

6.4. If cash on delivery is selected as a payment method, delivery times start to run from the date of receipt of the confirmation email sent by the supplier to the consumer. Upon payment by bank transfer or debit / credit card, the delivery terms start to run from the date of receipt of the value of the Order into the Bank account of the Provider, that is, from the confirmation of the bank account of the supplier with the final price of the order.

6.5. Shipping cost is indicated when generating each order.

6.6. Upon delivery of the Goods delivered, the User or a third party designated by him shall be obliged to sign the documents accompanying the Goods. Any person other than the consumer who executed the Order but who has accepted the same on behalf of the consumer shall be considered as a third party upon delivery of the goods at the delivery address specified by the latter in the order.

7. Refusal. Complaints

7.1. According to Art. 50 of the Consumer Protection Act (CPA), the consumer has the right to withdraw the goods received (from the distance sale contract concluded) without giving a reason, without owing compensation or penalty and without paying any payment. expenses, with the exception of the expenses provided for in Art. 54, para. 3 and Art. 55 of the CPA within 14 days from the date of: acceptance of the goods by the consumer or by a third party other than the carrier and indicated by the consumer or when the consumer has ordered many goods with one order, which are delivered separately as of the date , to which the consumer or a third party other than the carrier and designated by the consumer came into possession of the last good.

7.2. Information on the exercise of the right of withdrawal (Annex 7 to Article 47, Paragraph 4 of the Law on Public Procurement) Standard instructions for withdrawal:

  • Right to cancel the contract at a distance or off the premises.
  • You have the right to withdraw from this contract without giving any reasons for it within 14 days.
  • The withdrawal period is 14 (fourteen) days from the date on which you or a third party other than the carrier and designated by you have entered into possession of the goods or a contract under which the consumer orders many goods with one order, which deliver separately: the date on which you or a third party, other than the carrier and designated by you, took possession of the last good. In order to exercise your right of withdrawal, you must inform us of your name, geographical address and, if you have one, telephone number, fax number and e-mail address and your decision to withdraw from the contract with a clear application, such as a letter sent by post, fax or email. You can use the standard opt-out form provided, but this is optional. You may complete and electronically enclose the attached standard waiver form or other unambiguous waiver application on our website at www.dressyou.net. If you use this opportunity, we will immediately send you a durable email confirmation message that you have received the rejection. In order to comply with the termination period, it is sufficient to send your message regarding the exercise of the right of withdrawal before the expiry of the termination period.
  • Failure action. If you cancel this Agreement, we will refund all payments we have received to you, including the cost of your delivery (excluding any additional costs associated with your chosen shipping method other than the cheapest standard shipping method). delivery offered by us through the courier service of Speedy AD), without undue delay and in any case not later than 14 days from the date on which you inform us of your decision to cancel this contract. We will refund the amount due in accordance with the payment method used by you or according to your instructions and desire: by bank transfer, cash on delivery, cash on hand - in cash or through your virtual wallet linked to your registered account in e-commerce; We have the right to postpone the refund until we receive the goods back or until you provide us with proof that you have sent the goods back, whichever is the earlier. We expect you to send or return the goods to us without undue delay, in the form and condition in which they were sent to us, and in any case no later than 14 (fourteen) days after the day on which you informed us of your refusal. The time limit is considered to be fulfilled if you send us the goods back before the 14-day period expires. You must bear the direct cost of returning the goods. You are solely responsible for reducing the value of the goods or their total depreciation as a result of their testing and / or use, other than what is necessary to establish their nature and characteristics.

7.4. The consumer is entitled to a claim under the Consumer Protection Act. The supplier offers for sale second-hand goods, therefore, in exercising and satisfying the claims of non-conformity of second-hand goods with the content of the distance contract, taking into account the fact that they are offered second hand is the leading one. When exercising the right of claim, the consumer shall present the goods in the form and condition in which they were sent to him, as well as a receipt and / or invoice (if any); protocols, acts or other documents establishing the non-conformity of the goods with the agreed; as well as other documents establishing the claim by reason and size. If these requirements are not met, the supplier is not obliged to satisfy the user's complaint. Where the goods do not conform to the distance contract concluded, the Seller is obliged to bring it into conformity with the contract. Alignment of the goods with the sales contract should be done within 1 / one / month, starting from the date of submission of the complaint by the consumer.

7.5. В случай на отказ от договора или предявена рекламация потребителят се задължава да положи усилие за опазване на стоката до връщането ѝ на доставчика. Потребителят се задължава да положи усилия, за да върне стоката във вид и състояние, в които му е била изпратена от доставчика.

7.6. All transportation and any other costs of returning the Goods are entirely free. Until the moment of return of the Goods by the User to the Provider, the risk of accidental loss and damage or damage shall be borne entirely by the User.

8.Privacy Notice to Users

8.1. In addition, the provider "DressUp" Ltd. will also carry out the processing of personal data of users - visiting the e-shop, as guests or as retired users, using automated technologies including cookies, in order to analyze web traffic in the e-shop; providing advertising in accordance with the interests and preferences of consumers; ensuring the functionality of the e-shop and the security of the connection and the service when used by the user; performing other forms of direct marketing.

9. Other provisions

9.1. In the event of disputes arising out of, or in connection with, the conclusion and execution of distance sales contracts through the online shop of DressYou Asset Ltd., the parties will endeavor to resolve them in a spirit of understanding and mutual compromise. In case the parties fail to reach an agreement, the dispute between them shall be finally settled by the competent Bulgarian court. Alternatively, in the event of any disputes with DressYou Asset Ltd., the consumer is entitled to apply for resolution to the European Dispute Resolution Platform (ODR Platform) at https://webgate.ec.europa.eu /odr/main/?event=main.home.show&lng=EN, or before the General Conciliation Commission of the Consumer Protection Commission, based in Sofia. 9.2. For all issues not settled in these General Terms and Conditions, the provisions of substantive and procedural law apply. The Provider may change these General Terms and Conditions at any time by posting the changes made to www.dressyou.net in a timely manner within 7 / seven / days of their modification. In addition, with respect to already registered customers / users, the Provider is obliged to inform the same in a specified manner within 7 / seven / day period about the changes made by their telephone or e-mail or a correspondence address.

10. Delete profile

10.1. To delete your profile go to the settings menu and press the delete button or press here.

10.2. After confirming the deletion, you will still be able to use your account.

10.3. Within 30 days, you will be able to cancel the deletion.

10.4. After this period, the access to your account will be suspended.

10.5. You will have another 60 days to contact us to restore your account.

10.6. After that all of your data will be deleted.
